In order to maintain protection after your trademark is registered, you must file specific registration maintenance documents and pay fees between 5th and 6th years, 9th and 10th years, and every so years after. How to keep your trademark registration alive.
The USPTO requires that you submit maintenance documents for your trademark with the filing of a Statement of Use at the following intervals:
1. Between the 5th and 6th years after your trademark registration date;
2. Between the 9th and 10th years after your trademark registration date;
3. Every 10 years after that.
Optional:
If your mark is registered on the Principal Register and meets certain legal requirements, including at least five years continuous use in commerce, you may file an optional Declaration of Incontestability.
